01 · SMS Messaging Program
Program Name: DAIA Group SMS Communications
Program Description: By opting in to our SMS program, you consent to receive text messages from DAIA Group LLC. Message types include: appointment confirmations and reminders, pipeline status updates, service onboarding communications, performance reporting summaries, and operational notifications related to your engagement with DAIA Group services. Message frequency varies based on your service engagement and activity.
How to Opt Out
Text "STOP" to opt out at any time. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us.
To rejoin: Sign up again as you did initially and we will resume sending SMS messages to you.

02 · Use of Services
DAIA Group provides AI-powered real estate growth infrastructure services, including lead management, appointment booking automation, pipeline management, and reporting. By engaging our services, you agree to:
- Provide accurate and complete information during onboarding
- Use our services only for lawful purposes
- Not attempt to reverse engineer, copy, or resell our proprietary systems
- Comply with all applicable laws and regulations in your jurisdiction
- Not use our platform to send prohibited content, including SHAFT (sex, hate, alcohol, firearms, tobacco) content
03 · Prohibited Uses
You may not use our services to:
- Send phishing, smishing, or social engineering communications
- Transmit content that is illegal under federal or state law
- Harass, threaten, or harm any individual
- Violate any third-party intellectual property rights
- Circumvent any security or access controls on our systems
- Engage in any deceptive or misleading business practices
Violations may result in immediate termination of services and may be subject to fines in accordance with carrier non-compliance policies.
04 · Payment & Billing
Services are provided under a monthly retainer model as agreed upon in your service agreement with DAIA Group LLC. Payment terms, fees, and billing schedules are outlined in your individual service agreement. All fees are non-refundable unless otherwise specified in writing.
DAIA Group reserves the right to modify pricing with reasonable advance notice. Continued use of services after a price change constitutes acceptance of the new pricing.
05 · Intellectual Property
All content, systems, workflows, automation frameworks, and proprietary methodologies — including AppointStream™ — are the exclusive intellectual property of DAIA Group LLC. You are granted a limited, non-exclusive, non-transferable license to use these systems solely in connection with your active service engagement.
You may not copy, modify, distribute, sublicense, or create derivative works from any DAIA Group proprietary systems without express written consent.
06 · Limitation of Liability
To the maximum extent permitted by applicable law, DAIA Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use or inability to use our services.
Our total liability to you for any claim arising from these Terms or our services shall not exceed the total fees paid by you to DAIA Group LLC in the three (3) months preceding the claim.
07 · Indemnification
You agree to indemnify and hold harmless DAIA Group LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
08 · Termination
Either party may terminate the service relationship in accordance with the terms of the applicable service agreement. DAIA Group reserves the right to suspend or terminate access to services immediately if you violate these Terms or engage in conduct that may cause harm to DAIA Group, other clients, or third parties.
09 · Compliance with Industry Standards
DAIA Group LLC complies with all applicable industry standards and regulations governing SMS and A2P messaging, including CTIA Short Code Monitoring Handbook guidelines, TCPA requirements, and carrier-specific compliance policies. We are committed to maintaining compliant messaging practices and protecting the experience of all message recipients.
10 · Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in the State of Florida.
11 · Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Continued use of our services following notice of changes constitutes your acceptance of the revised Terms.
